Welcome to Qingtan services (the “Services”). This agreement is entered into between you and Shenzhen Hongcheng Technology Co., Ltd., the operator of Qingtan. Please read and understand every term, especially limitations of liability, governing-law and service-specific terms, before using the Services. By using Qingtan, you confirm that you accept and agree to be bound by this agreement.
If you are under 18 or do not have full civil capacity, please read this agreement with your legal guardian. Qingtan may update this agreement. Unless otherwise required by law, updated terms take effect seven days after publication; if you disagree, stop using the Services and notify us in writing.
1. Definitions and interpretation
- “Qingtan” means the legally recognized operator of Qingtan websites, mobile clients and related platforms.
- “Qingtan Services” include messaging, links to third-party services and new services introduced from time to time.
- “User” or “you” means the person using the Services.
- “Affiliate” means an entity that controls, is controlled by, or is under common control with Qingtan.
- You are responsible for safeguarding your account and password and for activity under your account.
- “Chinese law” means the laws and binding regulations in force in mainland China for purposes of this agreement.
2. Service content
Qingtan provides messaging and links that may allow access to third-party services. Qingtan is responsible only for its own technical service and links; a separate agreement may apply between you and a third party. You provide the devices, network access and related charges required to use the Services.
3. Account use and security
You must register an account, keep credentials secure and sign out safely. We recommend a password containing at least three of uppercase letters, lowercase letters, numbers and special characters. Where published terms are violated, Qingtan may restrict functions, suspend or terminate the account as permitted by law.
4. Personal information
To provide account, membership, security, compatibility and personalized functions, Qingtan may process information such as account name, nickname, password, email address, IP address, cookie information, device or browser data and usage records. Required information must be complete and accurate where the law requires it.
Qingtan uses security technologies and management controls to protect personal information. Information is not publicly disclosed or provided to third parties except with authorization, as required by law or competent authorities, to provide necessary technical services through affiliates or partners, or to protect public and legitimate interests. Details are governed by the Qingtan Privacy Policy.
5. Paid services
Some Services may require payment. Prices, methods and paid content are displayed on the relevant page and may be adjusted with notice. Virtual currency or items may be used to purchase paid services. Unless the agreement ends because of force majeure or the law requires otherwise, successful top-ups are not refundable. Payment purchases access to a service, not ownership of software.
Subscriptions may renew automatically unless cancelled at least 24 hours before renewal. After cancellation, access continues until the end of the current subscription period. Users are responsible for applicable taxes and must provide valid payment information when required.
6. User conduct
You must comply with applicable laws, policies and this agreement and are responsible for the legality, completeness and truthfulness of content you publish. User content does not represent Qingtan.
- Do not publish content prohibited by Chinese law, including content that endangers national security, public order or lawful rights; promotes obscenity, gambling, violence, terrorism or crime; spreads unlawful rumors; or insults or defames others.
- Do not use the Services for unlawful purposes, disrupt networks, infringe intellectual-property, reputation, portrait or other rights, or harm Qingtan or its affiliates.
- Qingtan may remove suspected unlawful content, restrict or close accounts, preserve relevant information and report to authorities as required by law.
- You may not exploit, transfer or license Qingtan intellectual property without written consent.
7. Privacy
You and Qingtan are also bound by the Qingtan Privacy Policy, which explains personal-information processing and your rights.
8. Intellectual property
Text, images, graphics, marks, trademarks, audio, video, software and accompanying materials supplied by Qingtan or other rightsholders are protected by intellectual-property and property laws. They may not be reproduced, distributed or used commercially without authorization. You may not reverse engineer, decompile or disassemble protected software unless the law expressly permits it.
9. Disclaimers and liability
To the extent permitted by law, Services are provided “as is” and “as available” without warranties of uninterrupted operation, accuracy, reliability, fitness for a particular purpose or freedom from errors. You use the Services based on your own judgment and bear risks not caused by Qingtan’s intentional misconduct or negligence.
Qingtan is not responsible for failures or delay caused by internet or communications failures, power failure, labor disputes, civil disorder, fire, flood, storms, force majeure, war, government action, court orders or third-party omissions. To the extent permitted by law, Qingtan is not liable for special, indirect, punitive, incidental or consequential losses. You agree to compensate Qingtan for losses caused by your unlawful use or breach, including reasonable legal costs.
10. Termination
Subject to law and this agreement, Qingtan may give advance notice of termination because of a breach, a government or judicial request, your account-deletion request, a rights complaint, technical or security failure, or a business-strategy adjustment. Where service or an account is closed, Qingtan bears responsibility only where required by law.
11. Governing law and disputes
The formation, validity, performance and interpretation of this agreement are governed by the laws of mainland China. The parties should first seek an amicable resolution; if no resolution is reached, either party may bring proceedings before a competent court where Qingtan is located.
12. Rights-protection notices
If you believe content in the Services infringes your lawful rights, you may submit a signed written notice identifying the rightsholder and agent, contact and identity documents, the exact work and network address, ownership evidence, infringement facts and supporting materials, together with a declaration that the submission is truthful, lawful and valid.
Send written notices and supporting evidence to: Room 427, Building 2, Youchuang Space, No. 3 Qunhui Road, Xin’an Street, Bao’an District, Shenzhen 518000, China. A person submitting an inaccurate notice is responsible for resulting legal liability and costs.
13. Other terms
This agreement forms the entire agreement on the matters it covers and binds successors. Qingtan may transfer rights or obligations to an affiliate without harming user rights. Headings are for convenience only. Severance or invalidity of one provision does not affect the remaining provisions. Qingtan may interpret the agreement within the limits permitted by law.
